Terms of Service

1. Eligibility and Accounts

Our Services are designed for teachers, parents, and students in grades K through 8. If you are under the age of 13, you may only use the Services with the permission and supervision of a parent, legal guardian, or teacher. Teachers and parents are responsible for ensuring that student use complies with applicable school policies and laws, including COPPA and FERPA where applicable.

You agree to provide accurate information when creating an account or contacting us, and to keep any access credentials (such as class join codes) secure. You are responsible for activity that occurs under your account.

2. License to Use the Services

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial educational purposes. Teachers and schools may use the Services with their students in classroom, tutoring, and at-home settings.

3. Acceptable Use

You agree not to:

• Use the Services in any way that violates any applicable law, regulation, or the rights of others
• Attempt to gain unauthorized access to any part of the Services, user accounts, or underlying systems
• Reverse engineer, decompile, scrape, or otherwise attempt to extract the source code or data of the Services, except as permitted by law
• Interfere with or disrupt the integrity or performance of the Services, including by introducing malware or excessive load
• Use the Services to harass, harm, defraud, or impersonate any person or entity
• Sell, resell, rent, or commercially exploit the Services or their content without our prior written permission

4. Intellectual Property

The Services, including all games, software, graphics, text, characters, mascots, logos, curriculum, and other content, are owned by Playpower Labs or its licensors and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved. The Playpower Games name and logo are trademarks of Playpower Labs.

5. User-Submitted Content and Feedback

If you send us feedback, suggestions, bug reports, or other communications about the Services, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use that feedback for any purpose, including improving the Services, without obligation to you. You represent that any content you submit does not violate the rights of any third party.

6. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect information generated from our educational games. By using the Services, you consent to the practices described in the Privacy Policy.

7. Third-Party Links and Services

The Services may contain links to third-party websites or services that are not owned or controlled by Playpower Labs. We are not responsible for the content, privacy practices, or availability of any third-party services, and your use of them is at your own risk and subject to their terms.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Services will be error-free or meet any specific educational outcome.

9. Limitation of Liability

To the maximum extent permitted by law, Playpower Labs and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Services will not exceed one hundred U.S. dollars (USD 100.00).

10. Indemnification

You agree to indemnify and hold harmless Playpower Labs and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Services, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms. You may stop using the Services at any time. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.

12. Changes to the Services and Terms

We may modify the Services at any time, including adding or removing features. We may also update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
